Article 1 - Definitions In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer may exercise their right of withdrawal;

  • Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance agreement with the entrepreneur;

  • Day: calendar day;

  • Right of withdrawal: the possibility for the consumer to waive the distance agreement within the cooling-off period;

  • Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance (Bzoia);

  • Distance agreement: an agreement whereby, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication;

  • General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance agreement concluded and orders placed between the entrepreneur and the consumer.

  2. Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer (via the webshop).

Article 4 - The Offer

  1. If an offer has a limited validity period, this will be explicitly stated.

  2. The offer contains a full description of the products. Given the handmade nature of the products and the use of natural materials, small variations in color and shape may occur. This is not considered a defect.

  3. Each offer contains sufficient information to make it clear to the consumer what the rights and obligations are upon acceptance, including prices, shipping costs, and whether or not the right of withdrawal applies.

Article 5 - The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and complies with the conditions set therein.

  2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance electronically.

Article 6 - Right of Withdrawal

  1. When purchasing standard products, the consumer has the option to dissolve the agreement without giving reasons for 14 days. This period starts on the day after receipt.

  2. During the cooling-off period, the consumer will handle the product and the packaging with care.

Article 7 - Costs in Case of Withdrawal

  1. If the consumer exercises their right of withdrawal, the costs of return shipping are at their expense.

  2. Policy outside the EU: For markets outside the EU, Bzoia (Vanessa Wagneur) may, in order to avoid high customs and transport costs, agree to a direct refund or replacement without the product having to be physically returned. This is always done after written consultation.

Article 8 - Exclusion of the Right of Withdrawal Exclusion of the right of withdrawal applies to products:

  1. That have been created by the entrepreneur in accordance with the specifications of the consumer or that are clearly personal in nature (custom-made/handmade upon request).

  2. That cannot be returned for hygienic reasons (such as earrings) if the seal has been broken or if they have been worn.

Article 9 - The Price

  1. The prices mentioned in the offer include VAT (for EU countries).

  2. For shipments outside the EU, any import duties and local taxes are the responsibility of the consumer, unless otherwise stated at checkout.

Article 10 - Conformity and Warranty

  1. The entrepreneur warrants that the products comply with the agreement and the reasonable requirements of reliability.

  2. The warranty does not apply if the consumer has modified the products themselves or in case of abnormal circumstances/insufficient care (e.g., contact with perfume or water for fragile pieces).

Article 11 - Delivery and Execution

  1. Bzoia will take the greatest possible care when executing orders.

  2. Out of stock: If a product is not in stock or is made to order, Bzoia will contact the consumer as soon as possible regarding the expected delivery time.

  3. If delivery within 30 days proves impossible, the consumer will be informed and has the right to dissolve the agreement free of charge.

Article 12 - Payment

  1. Unless otherwise agreed, amounts must be paid at the time of placing the order via the webshop. Orders will only be put into production or shipped after receipt of payment.

Article 13 - Complaints Procedure

  1. Complaints about the execution of the agreement must be submitted fully and clearly described via contact@braz.be within 14 days after discovery (in the case of visible defects).

  2. Submitted complaints will be answered within a period of 14 days.

Article 14 - Disputes

  1. Only Belgian law applies to agreements between the entrepreneur and the consumer.

  2. In case of disputes, the courts of the district where the entrepreneur (Bzoia) is established are competent.

Article 15 - Additional or Deviating Provisions Additional provisions may not be to the detriment of the consumer and must be recorded in writing.
